On April 29, 2002, Judge Sullivan conducted the hearing regarding MAMA's motion for summary judgment as scheduled. At the conclusion of the hearing, the judge indicated that he would be taking the case under advisement and would be issuing a written decision soon.

On May 6th Judge Sullivan issued his decision in favor of MAMA.
